1. Introduction
Welcome to Diveri. These Terms of Service ("Terms") govern your use of our website located at www.diveri.com (the "Website") and our mobile application (the "App"), collectively referred to as the "Service". Please read these Terms carefully before using the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Account Registration
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Service Purpose and User Eligibility
The Diveri Service is a knowledge, community and social connection platform for neurodivergent adults. Some optional features (such as a romantic connection intent) are only available to users who explicitly opt in. By using this Service, you confirm that you are at least 18 years old and are legally able to enter into this agreement.
While we aim to create an inclusive and supportive community, we reserve the right to refuse service to anyone for any reason at any time.
4. Platform Role — Not a Healthcare Provider
Diveri is a platform for knowledge, community and connection. Diveri is not a healthcare provider, not a mediator, and not a party to any treatment, coaching, counselling or care relationship. We do not provide medical, psychological, therapeutic or any other professional services ourselves.
Any professional listed in our "Find help" directory acts entirely on their own account and responsibility. Any relationship, agreement, appointment or service is solely between the member and that professional. Diveri verifies certain registrations (such as a BIG registration) at signup, but is not responsible for the services professionals provide, does not supervise or direct their work, and does not process payments for such services. Diveri does not employ these professionals and they are not "our" practitioners.
We facilitate discovery and contact only. Any decision to engage a professional, and any reliance on their advice or services, is made by you at your own discretion and risk.
5. Knowledge Base — Psycho-Education Only
Our knowledge base and related content are provided for informational and psycho-educational purposes only. They are not medical advice, not a diagnosis, and not a substitute for professional assessment, diagnosis or treatment.
You should always consult your general practitioner (huisarts) or another qualified healthcare professional for questions about your health. If you are in crisis or experiencing thoughts of suicide, contact your GP, call emergency services (112), or contact 113 Zelfmoordpreventie (113 / 0800-0113 in the Netherlands). Never disregard or delay seeking professional advice because of something you read on Diveri.
6. Forums and User-Generated Content
Our Service may include forums, messaging features, and other interactive areas where users can create, post, and share content ("User Content").
You are solely responsible for your User Content and the consequences of posting it. By posting User Content, you represent and warrant that:
- You own or have the necessary rights to use and authorize us to use your User Content;
- Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person or entity;
- Your User Content does not contain material that is false, intentionally misleading, defamatory, obscene, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, or otherwise objectionable;
- Your User Content does not encourage conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.
Diveri is not responsible for any User Content posted through the Service, and we expressly disclaim any liability arising from such content. However, we reserve the right to remove any User Content that violates these Terms or that we deem objectionable for any reason, without prior notice.
Zero tolerance. There is no tolerance for objectionable content or abusive users. You can report any profile, message, forum post or comment and block any user in the app. We act on reports promptly, remove offending content and remove users who post it.
7. Acceptable Use
You agree not to use the Service to:
- Violate any laws or regulations;
- Infringe upon the rights of others or violate their privacy or publicity rights;
- Send spam or unsolicited messages;
- Interfere with or disrupt the Service or servers or networks connected to the Service;
- Engage in abusive behavior towards other users, including harassment, bullying, or intimidation;
- Post false, misleading, or deceptive content;
- Collect or track personal information of other users;
- Use the Service for any illegal or unauthorized purpose;
- Attempt to probe, scan, or test the vulnerability of the system or bypass security measures.
8. Moderation, Reporting and Notice-and-Action
Diveri is a hosting service for content posted by its users. We want the community to be safe, and we take a notice-and-action approach to content moderation.
- Block and report. You can block other users and report content or behaviour that you believe violates these Terms or the law, directly within the Service.
- Review and action. Reports are reviewed and, where warranted, actioned. Actions may include removing or restricting content, issuing a warning, or suspending or terminating an account. We aim to act on notices without undue delay and, where appropriate, to inform the reporter and the affected user of the outcome.
- Illegal content. Content that is manifestly illegal, or that is required to be removed by law, will be removed once we become aware of it. Serious matters may be reported to the relevant authorities.
- Contact point. Users and authorities can reach our contact point for notices and moderation matters via diveri.app/contact. This is our single point of contact for communications regarding content moderation, including requests from authorities.
We reserve the right to remove content and to act on accounts as described in these Terms. Nothing in this section obliges Diveri to actively monitor all content, and it does not make Diveri a party to, or responsible for, content posted by users.
9. Third-Party Links
Our Service may contain links to third-party web sites or services that are not owned or controlled by Diveri. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
You acknowledge and agree that Diveri shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service, or you may contact us to request account deletion.
11. Limitation of Liability
In no event shall Diveri, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties;
- Any content obtained from the Service;
- Unauthorized access, use, or alteration of your transmissions or content;
- Statements or conduct of any third party on the Service;
- Any other matter relating to the Service.
12. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Diveri, its subsidiaries, affiliates, and licensors do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
